Terms of Service

These Terms govern use of the MineSTEM website, classroom platform and mobile apps for iOS and Android (the “Service”) provided by Minestem Inc. (“MineSTEM”, “we”). By using the Service you agree to them. If you are using the Service on behalf of a school or district, you agree on its behalf and confirm you are authorised to do so. A school’s written agreement with us, if any, takes precedence over these Terms where they differ.

1. Accounts

  • Teacher and administrator accounts are created by MineSTEM or by a school administrator. Student and family accounts are created by a teacher or administrator; students may not create accounts themselves.
  • You are responsible for keeping your credentials confidential and for activity under your account. Teachers are responsible for the student login cards they issue.
  • Tell us promptly at support@minestem.com if you believe an account has been used without permission.

2. Licence to use the Service and materials

We grant schools, their staff, students and families a limited, non-exclusive, non-transferable licence to use the Service and the MineSTEM curriculum materials (books, lesson pages, workbooks, newsletters and other content) for classroom and home instruction connected with the school’s use of MineSTEM. Teachers may print and copy student pages for their own students. You may not resell, redistribute, publish, or use the materials to build a competing product, or remove copyright notices.

3. Your content

Student work, uploads, portfolio items and messages (“Your Content”) remain the property of the school, the student or the family, as applicable. You grant us a licence to store, display and process Your Content only as needed to provide the Service to you. We handle Your Content in accordance with our Privacy Policy.

4. Acceptable use

Do not use the Service to upload content that is unlawful, harmful to children, infringing or abusive; to attempt to access other users’ accounts or data; to interfere with the Service’s operation; or to scrape or copy the Service or materials in bulk. Teachers and schools are responsible for supervising students’ use.

5. Fees

Curriculum materials and platform access are sold to schools under a purchase order, quote or online order. Prices and any subscription term are stated at the time of purchase. Except where required by law or stated in the order, fees are non-refundable.

6. Third-party services

Google and Clever sign-in are provided by those companies under their own terms.

7. Availability and changes

We work to keep the Service available and to fix problems promptly, but we do not guarantee uninterrupted service. We may improve or change the Service and materials over time and will give schools reasonable notice of changes that materially reduce functionality.

8. Disclaimer and limitation of liability

The Service and materials are provided “as is”. To the fullest extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental or consequential damages, and our total liability for any claim relating to the Service is limited to the fees the school paid us in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

9. Termination

A school may stop using the Service at any time. We may suspend or end access for a material breach of these Terms after notice where practical. On termination we delete personal information as described in the Privacy Policy and, on request made within 30 days, will provide the school with an export of its student work.

10. Governing law

These Terms are governed by the laws of the State of California, and disputes will be resolved in the state or federal courts located in Santa Clara County, California, unless a school’s agreement with us provides otherwise.
